There is no California Penal Code to arrest upon the utilization of HiCap magazines. If you are arrested, the DA has to prove that you either A. Imported the magazine or B. Manufactured the magazine, both of which are really hard to prove since there is no paper trail. Also, the statute of limitations on it is 3 years so if there is a paper trail showing that you imported or manufactured the magazine, the DA has to charge you within 3 years of importation or manufacturing. The use of HiCap magazines isn't illegal, the importation and the manufacturing of HiCap magazines are illegal. If you are ever caught with one Law Enforcement may question you but you don't have to answer to them since you aren't doing anything illegal. The best thing to do when you're asked is to just be polite and say "I own these magazines legally and will have no further discussion about them." I took my magazines to a range on saturday and blasted away 19 rounds from my standard capacity magazine. I call them standard because that is what it comes with from the factory. HiCap would be something along the lines of a beta magazine . Most of this info can be read on CalGuns. | |

lol, that's SSE if the very law you skated around in order to buy that gun! either way i don't care it's your buisness, i know there are tons of those guns in CA that were bought as single shot but i doubt there is one that actually is. 16rd mags for my xd sub? pffft i never saw them officer | |

16rd mags for my xd sub? pffft i never saw them officer I know what SSE is and that's how I got my XDM. The XDM as well as many other guns aren't actually illegal per se, they just haven't been approved by the CA DOJ (which means they just haven't paid CA the fee to be on the list ). CA DOJ approves of the SSE method so I did not acquire my gun illegally. If a gun isn't on the CA DOJ list it has to be SSE'd into the state. That means the gun HAS to be sold as a single shot pistol but once the gun is removed from the shop, the legal owner of the pistol is free to convert the gun back to semi-auto and this is perfectly legal as per DOJ. There are a lot of loop holes pertaining to California Gun Laws. | |

FYI, XD and the XDM, though may be extremely similar, are actually two different guns. One is on the DOJ roster list and is perfectly legal and one isn't. The one that isn't, the XDM, has to be transferred into the state as a single shot and sold as a single shot pistol. Once the pistol has been converted to single shot and sold as a single shot, the owner of the firearm is free to convert it back to semi-auto. The XDM is NOT ILLEGAL IN CALIFORNIA. If it was, DOJ would've put a stop to it a long time ago since they know I have this gun registered in the Republik of Kalifornia. | |
